PHYSICAL OWNERSHIP AND SEMEN INTERESTS
Terms and conditions of saleĀ *updated August 2021
Bulls auctioned by Te Mania Angus are sold strictly on the following terms and conditions:
The bull is the physical property of the buyer/s.
Semen from the bull must only be collected and used within the herds nominated (to a maximum of four herds) on the Buyer Registration form prior to the sale.
Semen from the bull cannot be sold, transferred or provided to any third-party without the prior consent of Te Mania Angus.
The purchase of the bull gives the buyer/s a licence to use the Te Mania Angus name and associated intellectual property to advertise progeny associated with insemination from the bull within the buyer's herd (licence).
If the buyer/s breaches any of these terms and conditions of sale, Te Mania Angus may revoke the licence immediately. Insemination of an animal of a herd not nominated on the Buyer Registration form is a breach of the licence.
Te Mania Angus retains the exclusive right to collect semen from the bull at a future date for the purpose of semen production and cloning. Semen will be collected at Te Mania Angus' expense and Te Mania Angus will arrange an appropriate time and place for collection that will not unreasonably interfere with the use of the bull by the buyer/s.
If the bull is re-sold by the buyer/s at a later date, these terms and conditions will apply to that purchaser or any person in possession of the bull and Te Mania Angus retains exclusive rights to continue to collect semen from the bull. The buyer can only transfer the bull if that subsequent purchaser accepts these conditions.
These terms and conditions align with Te Mania Angus' commitment to deliver the highest quality genetics and ensure protection of access to all genetics sold by Te Mania Angus into the agricultural marketplace.
